Under Section 204 of the FSMA, high-risk foods named in the Food Traceability List (FTL)—either as complete food products or as ingredients that make up other products—will be subject to enhanced traceability requirements.

In order to mitigate and prevent foodborne illnesses, the food and beverage industry has to go beyond modernizing systems for food recalls, market withdrawals and safety alerts. The industry must transform to provide real-time, end-to-end visibility of entire supply chains in order to safeguard the public.

And the imperative is now. Upcoming legislation, including the US FDA’s Food Safety Modernization Act (FSMA) that goes into effect on January 6, 2026, means F&B businesses will need to comply with new traceability rules to prove compliance and successfully undergo third-party audits.

FSMA Regulation 204 Has Come Into Effect

TRACEABILITY IN THE FOOD AND BEVERAGE INDUSTRY TO BE COMPLIANT

The legislation means that American agri-food companies and their international partners will be required to provide real-time traceability information to the FDA within 24 hours of an official request. Enforcement for non-compliance can range from penalty fees to court action and a suspension of a facility’s ability to sell or export a product. Other countries looking to do business in the United States or model their food safety initiatives after the US are likely to follow suit.

This means that agri-food companies that are subject to the rule must maintain up-to-date records on Critical Tracking Events (CTEs). These events are rules that oversee Harvesting, Cooling, Initial Packing, First Land-Based Receivers, Shipping, Receiving and Transformation.
